By accessing this website or using any Gaglani Enterprises hosting, web, or IT service (the “Services”), you agree to these Terms of Use. These Terms work together with your Consolidated Service Plan (CSP) and our Acceptable Use Policy, which are incorporated here by reference.
All use of the Services is subject to our Acceptable Use Policy, which prohibits spam, illegal or abusive activity, security violations, intellectual-property infringement, and prohibited content. You are strictly responsible for all use of your account, including use by your customers and any unauthorized use of your service.
You must take reasonable security precautions, protect the confidentiality of your passwords, and change them periodically. Because a compromised server can disrupt other customers, Gaglani may take your server offline if it is accessed by a third party without your consent.
Gaglani may, without prior notice, suspend or terminate your Services or remove content if it determines you have violated these Terms or the Acceptable Use Policy. Gaglani will attempt to contact you before suspending network access, but prior notification is not assured, and Gaglani may report unlawful activity to law enforcement.
Gaglani does not issue credits or refunds for outages incurred as a result of suspension or termination of the Services for a violation of these Terms or the Acceptable Use Policy. You agree to hold Gaglani harmless from any claims by your end users or third parties affected by such suspension or termination.
You may not use the Services in any manner that infringes or misappropriates the intellectual property rights of any third party. Gaglani reserves the right to suspend or terminate Services upon a third-party claim of infringement, subject to the process described in the Acceptable Use Policy.
If you own a Gaglani custom dedicated account, you are solely responsible for any security breaches affecting servers under your control and are liable for the cost of repairing any damage resulting from a breach. Gaglani is not accountable for any loss of data or service resulting from actions it takes in response to such breaches.
Gaglani is under no duty to monitor or police customer activity and disclaims responsibility for any misuse of the Services. Gaglani disclaims any commitment to any person who has not entered into an agreement with Gaglani Enterprises for services.
Because the Internet continues to evolve, we may amend these Terms and the Acceptable Use Policy from time to time to describe reasonable restrictions on your use of the Services. Continued use of the Services after a change constitutes acceptance of the updated Terms.
